A-901 Solid Waste Transporter License

The A-901 license is the cornerstone requirement and the most intensive licensing process for waste haulers anywhere in the United States. It is administered by the NJDEP Division of Solid and Hazardous Waste under N.J.S.A. 13:1E-126 et seq.

The application requires personal history disclosures for all owners, officers, and directors; fingerprinting and NJ State Police background checks for all principals; detailed financial disclosures; and disclosure of all related business interests.

Warning

Processing time for an A-901 License can exceed 12 months due to the extensive background investigation. Plan far ahead if you are entering the New Jersey market. You cannot legally haul waste without this license.

Certificate of Public Convenience and Necessity (CPCN)

In addition to the A-901, haulers must obtain a CPCN from NJDEP per N.J.A.C. 7:26H. The CPCN authorizes the specific types of waste and geographic areas you may serve. Annual updates are due in June.

Vehicle registration and decals

Every vehicle used to transport solid waste must be registered with NJDEP and display the appropriate decal. Licensed haulers receive solid-color decals. Self-generators hauling their own waste receive cross-hatched decals after filing an Affidavit of Exemption under N.J.S.A. 13:1E-127g.

All vehicles must also carry commercial NJ Motor Vehicle Commission registration.

Any company hauling waste generated by others must obtain the A-901 License. The statute mandates personal history disclosures, fingerprinting, and background checks by the NJ State Police. Annual updates are due November 1.

Self-generators (hauling your own waste only)

If you are hauling only waste you generated yourself (not waste from customers), you may be exempt from the A-901 requirement. However, you must still complete an Affidavit of Exemption and obtain cross-hatched vehicle decals from NJDEP. You must also deliver waste only to facilities authorized to accept it.

Hazardous waste

Zoning for dumpster placement is regulated at the municipal level in New Jersey. Most municipalities require a temporary use permit or construction permit for dumpsters placed on public streets or rights-of-way. Common requirements include reflective tape or markings, placement away from fire hydrants and intersections, and time limits (typically 14–30 days with extensions available for active construction projects).
